Buyer Agent Representation

The Buyer appoints Registered Agent ("Broker") as their exclusive real estate representative for the purpose of identifying and acquiring residential real estate, including new construction or development properties.

Builder Registration & Representation

The Buyer agrees that Broker shall be listed as their representative on all registrations or initial visits to builder model homes, communities, or developments. Buyer shall not independently contact, tour, or register with any builder or developer without Broker present or without prior written consent from Broker. If Buyer has previously visited or registered with builder prior to executing this agreement, Buyer agrees to disclose this in writing to Broker immediately.

Broker Compensation

The Buyer understands that Broker’s compensation is typically paid by the builder or seller, and that this agreement does not obligate the Buyer to pay commission directly unless otherwise agreed in writing. If a builder refuses to compensate the Broker due to failure to properly list or register Buyer, the Buyer may be responsible for covering the commission as outlined in an attached commission schedule (if applicable). Builder acknowledges and agrees that Broker compensation for services rendered under this agreement shall be 2.5% of the final purchase price of the property.

Term of Agreement

This agreement shall commence on the date signed and shall continue until: A binding purchase agreement is executed for a property, or Either party terminates the agreement with written notice, subject to paragraph 6. This Agreement shall commence on the date signed below and shall remain in effect for a period of six (6) months, unless terminated earlier in accordance with the terms herein. If the Buyer has not entered into a binding purchase agreement for a property within this six-month period, this Agreement shall automatically expire and be of no further force or effect, unless renewed in writing by both parties. Should the Buyer enter into a purchase agreement for a property introduced by Broker within 90 days following the expiration of this Agreement, Broker shall remain entitled to compensation in accordance with the terms set forth herein.

Duties of Broker

The Broker shall: Assist Buyer in identifying and evaluating new construction or development opportunities; Accompany or facilitate registration with builders; Negotiate purchase terms and conditions; Coordinate with builder representatives, lenders, and closing agents to support the transaction through closing.

Termination

Either party may terminate this agreement with written notice. If the Buyer enters into a purchase agreement within 90 days of termination for a property introduced by Broker during the term, the Broker shall still be entitled to compensation as if this agreement remained in effect.

Limitation of Liability

Builder shall not be liable for acts, omissions, or representations made by broker or other unaffiliated parties. Buyer acknowledges that new construction purchases involve risks, including construction delays, material shortages, and pricing changes.

Entire Agreement

This Agreement represents the entire understanding between the Builder and Broker. Any amendments must be in writing and signed by both parties.

Governing Law

This Agreement shall be governed by the laws of the State of Indiana (or applicable state of transaction if different).
